Ask Sponsored Listings Trademark Policy

Effective Date: May 23, 2007

IAC Search & Media requires its advertisers to respect the intellectual property of others. As stated in our ASL program terms and conditions, advertisers are solely responsible for the content of their advertisements and the terms they use for targeting their advertising. Such responsibility includes ensuring that their use of such content is not violative of any intellectual property rights of others, notably trademarks. IAC Search & Media.com is not a publisher of the advertisements provided or produced by advertisers and simply facilitates the placement of such advertisement on the ASL network. Therefore IAC Search & Media cannot arbitrate disputes between advertisers and trademark owners.

However, since we are mindful of the intellectual property rights of others, we are willing to briefly investigate good faith claims by trademark owners which may be brought to our attention. If we determine that a protected trademark is used in the content of an ASL advertisement, we will request that the advertiser remove the allegedly infringing content or we will remove the advertisement.

Any investigation by IAC Search & Media will be limited to claims concerning ASL ads served by IAC Search & Media. IAC Search & Media will not investigate nor will respond to trademark claims with respect to listings or websites that appear in non-paid search results. For any such claims, please contact the owner of the relevant web-sites.

We also encourage trademark owners to make their claims directly with the owners of the allegedly infringing web-sites or advertisements, or the Internet service provider that hosts such websites. This is a much more effective way to resolve trademark claims, particularly because advertisers may have similar advertisements on other sites.

If you believe in good faith that your trademark has been used by one of our advertisers in violation of your trademark rights, please fill in and submit our Trademark Claim Form or provide IAC Search & Media’s trademark agent the following information by email, fax or mail:

1. Your name (exact name of company if the trademark owner is a company), address, telephone number, email address and other useful contact information;
2. A description of the trademark that you claim has been infringed including:
- the exact mark (please specify whether it is a design mark or word mark)
- the countries/geographical areas of registration/claimed protection
- the registration number (or indicate if the registration is pending or if you claim trademark rights under a common law doctrine of use)
3. A description of where the material that you claim is infringing is located (please indicate the exact URL displayed on the bottom line of the listing or other identifying information);
4. A description of the reasons why you claim the content of the advertisement infringes on your trademark rights;
5. A statement by you that you have a good faith belief that the disputed use is not authorized by the trademark owner, its agent, or the law;
6. A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the trademark owner or authorized to act on the trademark owner's behalf;
7. An electronic or physical signature of the person authorized to act on behalf of the trademark owner.
